Client: Our company has bought a container of gherkins from a company in Vietnam which had multiple problems upon arrival in Rotterdam. We have requested the producer to take responsibility for the problem, but they don’t reply to most of our questions. If they reply, they ask for more information or to send info by e-mail.
We have sent them an official letter requesting them to take back the goods or instruct us otherwise what to do with these goods, which are not fit for human consumption anymore.
Again no reply.
We want to solve this matter soon because the product is partly rotting away on our customer’s site, causing a terrible smell and further deterioration of products is expected. Therefore we need some assistance from a legal office that could communicate with the producer and also point out their legal obligations. As damage is involved we have to stipulate also a way to recover the amount from them.
