Q: Well noted your below clarification , but for the 2nd problem about the house leasing and personnel recruitment, we prefer to get your assistence if we apponit you as our attorney agent to handle all the matters related R.O. Because as the requirement docs , the office leasing contracts is also be required ,and also should show the address in the applicaiton form . so if we havnt leased the office ,so how can you apply the license on behalf of us ?
What’s more ,for the personnel recruitment, as we dont know about the vietnamese labour law ,and so we need your help to check the labour recruitment , and we will employ the local labour without breaking the local lobour law.
Finally ,we want to establish the R.O by the name of our American branch company “America trading INC”, and our head office “Tenan trade co.,ltd” ,is it workable as per the vietnam law ?
A: As stated in our previous email, we can recommend you real estate agency for you and you can deal with them to lease the office. We can also assist you to review the office lease contract so that it shall best protect your right and interest under Vietnam Law. However, such review shall be subject to a separate service package. The fee for this is from 200USD.
Regarding to the employment, after obtaining the License for Representative Office, we shall send you general guidance on operation of the Representative Office, in which, you shall find necessary notes regarding to employment in Vietnam. If you need us further review employment contract with employees under Vietnam Law, such review shall be subject to a separate service package. The fee for this is from 350USD.
Regarding to your question about whether it is workable to register the R.O under the name of your branch company in America and head office in China, we do not quite understand your question. In Vietnam, it is impossible to register one R.O under the name of two entities (i.e. branch company in USA and head office in China). In such case, you must setup 02 separate representative office.
