On January 16, 2017, the government has promulgated Decree 03/2017/NĐ – CP of casino business. This Decree deals with business, management of the business and administrative sanction in casino business in Vietnam. Decree 03/2017 will take effect from March 15, 2017.
1. Business principles
Casino business is business lines subject to conditions and must be close controlled by competent authority to ensure that the operations of casino business complied with the provisions of this Decree and relevant law. Only enterprises which is granted Certificate of satisfaction of casino business conditions in accordance with this Decree will have the legal right to do casino business.
2. Subjects which are played casino in Vietnam
– Foreigner and oversea Vietnamese people situated abroad with a valid foreign passport would be allowed to enter casino in Viet Nam. These subjects must have full legal capacity for civil acts in accordance with Vietnam’s law and voluntarily comply with game rules, principles of casino business location and this Decree.
– The government allows Vietnamese people on pilot to play at casino business location. The pilot period is expected to be 03 years and after that the government will review, evaluate and decide whether to continue or terminate to allow Vietnamese people to play casino in Viet Nam.
The conditions of Vietnamese people allowed to play at casino business location is as follow:
+ The player must be aged 21 or over and have full legal capacity for civil acts in accordance with Vietnam’s law.
+ The player must have sufficient financial capacity to take part in casino services. They must demonstrate regular income from 10 million per month or more, or subject to third degree taxation or above in accordance with the Law on Personal Income Tax.
+ Players must buy tickets to the casino at 1 million VND (45 USD) for 24 hours entry and 25 million VND (1,126) per person monthly. Players must not be related to casino owners in any way.
+ Vietnamese people allowed to play at casinos must use VND to exchange for tokens and vice versa.
3. Conditions for enterprise
Decree 03/2017 promulgates that the capital for large casino business is at least 2 billion USD but does not restrict the amount of capital for business owners who run small casino. The casino business must be linked to the entrepreneur’s key commercial operations to help boost tourism, trade, diversify entertainment and recreation and enrich tourists’ experience, while assuring security and nation
