Client has intention to engage a legal consultant on advising and implementing the marriage registration with foreign elements in accordance with current Vietnam’s Laws. In which the parties in marriage need to satisfy the following general conditions:
+ The man has reached the age of twenty or over, the woman has reached the age of eighteen or over;
+ The marriage is voluntarily decided by the parties; neither partner is allowed to force or deceive the other; nobody is allowed to force or obstruct their marriage;
+ The marriage does not fall into one of the circumstances where marriage is forbidden as prescribed in Article 10 of Vietnamese Law on Marriage and Family.
SBLaw agrees to perform the legal consultation services for advising and implementing the marriage registration with foreign elements at the Department of Justice of Ho Chi Minh City and the Vietnamese relevant competent authority (hereby referred as “the competent authority”).
Providing advices on all legal aspects relating to procedures on marriage registration with foreign elements in Vietnam between Mr. […], nationality […], passport No. […], permanent residing at […] and Mrs. […], nationality […], passport No. […], permanent residing at […] (hereinafter referred as “the Marriage Parties”).
Guiding the Marriage Parties to prepare the support documents applicable for marriage registration with foreign elements at the competent authority;
Drafting the necessary letters according to the specific regulations of the competent authority;
Supporting the Marriage Parties to conduct the procedures on marriage registration with foreign elements as follows:
(i) The submission of application dossiers: preparing, interpreting and guiding the Marriage Parties to submit the application at the competent authority;
(ii) The face-to-face interviews: guiding, interpreting and supporting the Marriage Parties to conduct the face-to-face interviews held by Department of Justice of HCMC. In case the Department of Justice requests the re-interviews, SB Law shall support in maximum two more times.
(ii) Granting the Marriage Certificate: guiding, interpreting and supporting the Marriage Parties to conduct the Ceremonies for marriage registration at Department of Justice until the Marriage Parties are handed over the Certificate.
Timing
Within 01 (one) working day from the signing date of this contract, SB Law shall deliver the checklist of information and necessary documents for marriage registration with foreign elements;
Within 05 (five) working days from full receipt of information and necessary documents delivered by Client, SB Law shall deliver the application dossiers for reviewing and proceeding;
Within 01 (one) working days from full receipt of signed document provided by the Marriage Parties, SB Law shall support the Marriage Parties to submit the application dossiers at competent authority;
After 15 (fifteen) working days from duly submission of dossier to competent authority, SB Law shall support the Marriage Parties to conduct the face-to-face interviews held by Department of Justice of HCMC. The execution time for conducting such procedure shall be within 01 (one) working day or shorter up to the contents of interviews requested by Department of Justice’s officer;
In case the Department of Justice requests the re-interviews, after 30 (thirty) working days from the date of first interview, SB Law shall support the Marriage Parties to conduct the re-interviews with the same execution time.
Within 07 (seven) working days from the date of passing the face-to-face interviews, Department of Justice shall make the verification at the provincial Department of Public Security;
Within 05 (five) working days from the date of receiving the verification results of Department of Public Security, Department of Justice shall transfer the dossiers to People’s Committee of HCMC for approval;
Within 05 (five) working days from the date of receiving the application dossiers and the included documents, the People’s Committee of HCMC shall issue the Marriage Certificate and forward to Department of Justice;
Within 05 (five) working days from the date of receiving the original Marriage Certificate, Department of Justice shall hold the Ceremonies for marriage registration and request the both signatures of the Marriage Parties before handing over the Marriage Certificate.
