This is the content of the Decree No. 81/2016/ND-CP dated July 01, 2016 of the Government amending and supplementing a number of articles of the Government’s Decree No. 25/2011/ND-CP dated April 06, 2011, detailing and guiding the implementation of a number of articles of the Law on Telecommunications.
In particular, within 15 working days after receiving a valid dossier, the telecommunications specialized management agency shall coordinate with relevant agencies in appraising the dossier and grant a telecommunications service provision license to the business; in which, the duration according to current law is 45 working days.
Similarly, the Decree also reduced the duration for extending telecommunications service provision license from 40 working days to 15 working days. Accordingly, a business that wishes to have its telecommunications service provision license extended shall send 3 sets of dossier of request for extension to the telecommunications specialized management agency at least 60 days before the license expires, and shall take responsibility for the accuracy and truthfulness of its dossier. The telecommunications specialized management shall appraise and decide to extend the license within 15 working days after receiving a valid dossier.
Also in accordance with this Decree, the business that be granted a telecommunications service provision license should be not in the process of division, splitting, consolidation, merger, transformation, dissolution or bankruptcy under an issued decision or should has an organizational apparatus and manpower to implement the business plan, technical plan and plan to ensure telecommunications infrastructure safety and information security.
This Decree takes effect on July 01, 2016.
