According to Article 115 of the Code, the employee shall be entitled to the following public holidays and the same shall be fully paid leave:
a. One day holiday on 1st
January for the New Year
b. Five days holiday for the Lunar New Year
c. One day holiday on 30th
April for Victory Day
d. One Day holiday on 1st
May for International Labor Day
e. One day holiday on 2nd
September for National Day
f. One day holiday for Hung King’s Commemoration Day
The above holidays are applicable even to foreign citizen employees. In addition they are also entitled to take additional holiday of their traditional Tet and their country’s National Day.
If the public holiday falls on a weekly off then the employer should provide the following day as a compensatory day-off.
