We understand that you requires us to advise on whether the Employer’s responsibility on paying social insurance for employee.
According to the Article No. 2 of Vietnam Law on Social Insurance, it is stipulated that:
– Employee working under the seasonal labor contract or labor contract for specificic works having terms from 3 to less than 12 months and Employee working under the fixed term labor contract having term from 1-3 months… shall be entitled to compulsory social insurance pay.
If your company entered into fixed term labor contract having term from 1 month upward, the employee shall be entitled to compulsory social insurance.
However, if your company entered into seasonal labor contract or labor contract for specific works having term less than 3 months, the employee shall not be entitled to compulsory social insurance.
